HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This HIPAA Notice of Privacy Practices (“Notice”) applies to JAWS Podiatry and its Fugly Toenails™ telemedicine platform. It describes how JAWS Podiatry may use and disclose your Protected Health Information (“PHI”) and explains your rights regarding your PHI.
1. Our Duties

Maintain the privacy and security of your PHI as required by HIPAA and applicable law.

Provide you with this Notice explaining our legal duties and privacy practices with respect to PHI.

Follow the terms of the Notice currently in effect.

Notify affected individuals following a breach of unsecured PHI when required by law.

Designate a HIPAA Privacy Officer / Privacy Contact to receive questions, requests, and complaints regarding privacy practices.
2. How We May Use and Disclose PHI Without Written Authorization
We may use or disclose PHI for the following purposes, as permitted by HIPAA and applicable law:

Treatment: To evaluate your case, determine appropriate next steps, coordinate care, prescribe treatment when clinically appropriate, communicate with providers, and support follow-up.

Payment: To process payments, determine eligibility for paid services, coordinate billing, handle payment disputes, and support pharmacy or fulfillment-related payment functions where applicable.

Healthcare Operations: To operate and manage the practice and platform, maintain records, conduct quality review, compliance, training, security, auditing, legal review, and business operations.

Business Associates: To vendors or service providers that perform functions on our behalf and agree to safeguard PHI as required by HIPAA where applicable.

Required by Law: When federal, state, or local law requires disclosure.

Public Health and Safety: For public health activities, preventing or controlling disease, adverse event reporting, or preventing a serious threat to health or safety when permitted by law.

Health Oversight Activities: To licensing boards, regulatory agencies, audits, investigations, inspections, or other legally authorized oversight activities.

Judicial, Administrative, and Law Enforcement Purposes: In response to court orders, subpoenas, lawful process, or other legally permitted requests.

Workers’ Compensation or Similar Programs: When permitted or required by applicable law.

Other Uses Permitted by HIPAA: Including uses or disclosures for specialized government functions, coroner or medical examiner purposes, and other purposes permitted by law.
3. Uses and Disclosures Requiring Written Authorization
Certain uses and disclosures of PHI require your written authorization unless otherwise permitted by law, including many uses or disclosures for marketing, sale of PHI, or disclosure of psychotherapy notes if applicable. You may revoke an authorization in writing, except to the extent we have already relied on it.
4. Your HIPAA Rights

Right to Inspect and Receive a Copy: You may request access to inspect or receive a copy of certain PHI maintained in your designated record set, subject to legal limitations.

Right to Request Amendment: You may request that we amend PHI that you believe is incorrect or incomplete. We may deny the request in certain circumstances and will explain the reason if we do so.

Right to an Accounting of Disclosures: You may request an accounting of certain disclosures of your PHI, excluding disclosures for treatment, payment, healthcare operations, and certain other disclosures.

Right to Request Restrictions: You may request restrictions on certain uses or disclosures of PHI. We are not required to agree to every requested restriction, except in limited circumstances required by law.

Right to Request Confidential Communications: You may request that we contact you in a specific way or at a specific location. We will accommodate reasonable requests when required or appropriate.

Right to Receive a Paper or Electronic Copy of This Notice: You may request a copy of this Notice at any time.

Right to Be Notified of a Breach: You have the right to be notified following a breach of unsecured PHI when notification is required by law.

Right to File a Complaint: You may file a complaint with us or with the U.S. Department of Health and Human Services if you believe your privacy rights have been violated. We will not retaliate against you for filing a complaint.
5. Right to Change This Notice
We reserve the right to change the terms of this Notice and to make the revised or changed Notice effective for PHI we already maintain as well as PHI we receive in the future. The current Notice will be posted on the website when applicable and will include the effective or last updated date.
