Patient Rights and Responsibilities

This summary is intended to help patients understand important rights and responsibilities when receiving care or seeking services through JAWS Podiatry and the Fugly Toenails™ telemedicine platform. It is provided for patient information and should be read together with applicable Florida law, HIPAA rights, the Telemedicine Informed Consent, and the Terms of Service.

1. Patient Rights

  • You have the right to be treated with courtesy, respect, dignity, and consideration.

  • You have the right to know the name, function, and qualifications of healthcare providers involved in your care or evaluation.

  • You have the right to receive information about available services, eligibility requirements, fees, and appropriate next steps.

  • You have the right to receive information about your condition, proposed evaluation, treatment options, risks, benefits, alternatives, and limitations in a manner you can reasonably understand, when such information is available and clinically appropriate.

  • You have the right to participate in decisions about your care and to accept or refuse treatment, except as otherwise provided by law.

  • You have the right to privacy and confidentiality of your health information as required by HIPAA and applicable law.

  • You have the right to request access to or copies of your medical records in accordance with applicable law and practice policies.

  • You have the right to receive information about charges, fees, and payment obligations before payment is processed for paid services or products.

  • You have the right to ask questions and receive a reasonable response to requests related to your care, privacy, billing, or the platform.

  • You have the right to express concerns or complaints without retaliation.

  • You have the right to seek in-person care, urgent care, or emergency care when needed. This platform is not intended for emergencies.

2. Patient Responsibilities

  • Provide accurate, complete, and current information about your identity, age, Florida residency, physical location, symptoms, medical history, medications, allergies, prior treatments, photographs, and other information requested for eligibility review or evaluation.

  • Notify us promptly if your symptoms worsen, if your health status changes, if you develop urgent symptoms, or if you are no longer physically located in Florida at the time of evaluation.

  • Ask questions if you do not understand information, instructions, risks, limitations, fees, or next steps.

  • Follow provider instructions if treatment or follow-up is recommended, and inform the provider if you cannot or choose not to follow the recommended plan.

  • Seek in-person medical care or urgent medical attention if you experience severe pain, drainage, spreading redness, warmth, fever, signs of active infection, or any urgent medical concern.

  • Call 911 or go to the nearest emergency room if you are experiencing a medical emergency.

  • Use communication channels responsibly and avoid sending medical or health information through payment memo fields, public social media, or other non-secure channels.

  • Keep appointments, provide requested information in a timely manner, and meet financial obligations for paid services or products when applicable.

  • Treat providers, staff, and other patients with courtesy and respect.
