Telemedicine Informed Consent

This Telemedicine Informed Consent explains the nature, limitations, potential benefits, and potential risks of receiving telemedicine services through Fugly Toenails™, a platform operated by JAWS Podiatry in Hollywood, Florida.
1. Florida-Only Eligibility
Fugly Toenails™ telemedicine services are available only to eligible adults who are Florida residents and physically located in the State of Florida at the time of evaluation. By using the platform or submitting an evaluation form, you represent that the information you provide regarding your age, residency, location, symptoms, medical history, and eligibility is accurate and complete.
2. Provider Identity and License Verification
Telemedicine services on this platform may be provided or clinically supervised by Dr. Abraham Wagner, DPM, a double board-certified podiatric physician licensed by the Florida Board of Podiatric Medicine, or by another Florida-licensed podiatric provider within JAWS Podiatry, as applicable. Dr. Wagner’s Florida podiatric physician license is listed as PO3262. Patients may verify provider licensure through the Florida Department of Health license verification portal.
3. Nature of Telemedicine Services
Telemedicine may involve the use of asynchronous intake forms, photographs, electronic communications, phone calls, text messages, video consultation, and other digital or remote communication tools to support eligibility review, medical evaluation, patient education, treatment coordination, follow-up, and related services.
The Professional Virtual Evaluation, if selected, is an optional paid live telemedicine consultation. The price of any paid service will be communicated before payment is processed.
4. Standard of Care and Medical Records
Telemedicine services are provided according to the same professional standard of care that applies to comparable in-person healthcare services in Florida. Telemedicine services and related communications may be documented in your medical record according to the same standard used for in-person services.
5. Potential Benefits and Risks
Potential benefits may include more convenient access to provider review, reduced need for an initial in-person visit for eligible cases, and structured follow-up when appropriate. Potential risks include limitations in the information available to the provider, technical failures, delays in communication, limitations of photographs or remote assessment, privacy or security risks inherent in electronic communications, and the possibility that in-person care or additional testing may be required.
6. Limitations of Telemedicine
Telemedicine is not appropriate for every patient or every condition. Provider review may determine that your case requires in-person evaluation, urgent medical care, laboratory testing, confirmatory testing, or care by another healthcare provider. Submitting an eligibility screener, contact form, evaluation form, photographs, payment, or other information does not guarantee eligibility, diagnosis, treatment recommendation, prescription treatment, or prescription fulfillment.
If you are experiencing severe pain, drainage, spreading redness, warmth, fever, signs of an active infection, or any urgent medical concern, you should seek in-person medical care or urgent medical attention immediately. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
7. Prescription Treatment and Fulfillment
Prescription treatment may be issued only when clinically appropriate after eligibility screening, provider review, medical eligibility assessment, and approval by a Florida-licensed provider. No prescription product is issued, dispensed, released, shipped, or fulfilled without provider approval and medical eligibility. Some kits may include supportive products in addition to prescription products.
The price of any prescription product, treatment, evaluation, or related service will be clearly communicated before payment is processed and before fulfillment is initiated. Fulfillment, if applicable, may be coordinated through an authorized dispensing pharmacy.
8. Laboratory Testing and In-Person Care
Depending on your condition, medical history, medications, risk factors, and provider judgment, laboratory testing, confirmatory testing, or in-person evaluation may be required or recommended before or during treatment. If such steps are needed, our team will advise you on appropriate next steps.
9. Privacy, Security, and Electronic Communications
Telemedicine involves electronic communications that may include PHI. JAWS Podiatry and Fugly Toenails™ implement reasonable safeguards to protect PHI in accordance with HIPAA and applicable privacy and healthcare requirements. You should use private, secure networks and avoid submitting sensitive health information through channels not intended for healthcare information, including payment memo fields or public social media.
10. Recording of Telemedicine Communications
Fugly Toenails™ and JAWS Podiatry do not routinely record telemedicine visits. If recording of a telemedicine consultation is requested or required for a specific purpose, prior consent will be obtained where required. Patients may not record audio, video, or screen content from a telemedicine consultation without prior consent from the provider and all participants, and any recording must comply with applicable law.
11. Patient Responsibilities
You are responsible for providing accurate and complete information, updating us if your health status changes, following provider instructions if treatment is recommended, asking questions if you do not understand information provided, and seeking in-person or urgent care when symptoms or circumstances require it.
12. Consent and Withdrawal
By using the telemedicine platform, submitting an evaluation form, participating in a Professional Virtual Evaluation, or consenting through a form, you acknowledge that you understand the nature and limitations of telemedicine and consent to receive services through telemedicine when clinically appropriate. You may withdraw consent to telemedicine services by notifying us, but withdrawal may affect the ability to continue telemedicine care.
