These Terms of Service (“Terms”) govern your use of fuglytoenails.com, the Fugly Toenails™ telemedicine platform, related forms, eligibility screeners, content, communications, and services operated by JAWS Podiatry. By using the website or submitting a form, you agree to these Terms.

1. About Fugly Toenails™

 

Fugly Toenails™ is a telemedicine platform operated by JAWS Podiatry in Hollywood, Florida. The platform helps eligible Florida patients start with eligibility screening and provider review for fungal toenail and foot-related concerns. When clinically appropriate, a Florida-licensed podiatric provider within JAWS Podiatry may recommend telemedicine care, prescription treatment, supportive care, in-person care, or another next step.

2. Eligibility and Florida-Only Services

 

Fugly Toenails™ telemedicine services are available only to eligible adults who are Florida residents and physically located in the State of Florida at the time of evaluation. Individuals outside Florida are not eligible for telemedicine evaluation or prescription treatment through this platform and should consult a licensed provider in their own jurisdiction.

By using the eligibility screener, evaluation form, or telemedicine services, you represent that you are at least 18 years old, a Florida resident, physically located in Florida at the time of evaluation, and legally able to provide consent.

3. Provider Identity and License Verification

 

Telemedicine services may be provided or clinically supervised by Dr. Abraham Wagner, DPM, a double board-certified podiatric physician licensed by the Florida Board of Podiatric Medicine, or by another Florida-licensed podiatric provider within JAWS Podiatry, as applicable. Dr. Wagner’s Florida podiatric physician license is listed as PO3262. Patients may verify provider licensure through the Florida Department of Health license verification portal.

4. No Automatic Patient-Provider Relationship

 

A patient-provider relationship is not established by visiting the website, reading website content, completing the eligibility screener, submitting a contact form, submitting photographs, sending a message, or submitting payment. A patient-provider relationship may be established only when a Florida-licensed provider accepts the case for review and makes a clinical determination based on the information submitted and any additional information deemed necessary.

5. Telehealth Standard of Care

 

Telemedicine services are provided in a manner consistent with the provider’s scope of practice and the professional standard of care applicable to comparable in-person healthcare services in Florida. Telemedicine services may be documented in the patient’s medical record according to the same standard used for in-person services.

6. Medical Information and No Emergency Use

 

Website content is provided for general informational purposes and does not replace professional medical advice, diagnosis, or treatment. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. If you experience severe pain, drainage, spreading redness, warmth, fever, signs of an active infection, or any urgent medical concern, seek in-person medical care or urgent medical attention.

7. Eligibility Screener, Contact Form, and Evaluation Forms

 

The Eligibility Screener is designed to help determine whether you meet basic criteria for proceeding to additional forms or provider review. Contact forms are for general inquiries only and do not provide diagnosis, treatment recommendations, prescriptions, or emergency care. Evaluation forms may request health-related information, photographs, consents, and other information needed for provider review.

Submitting any form does not guarantee eligibility, medical evaluation, diagnosis, treatment recommendation, prescription treatment, or prescription fulfillment.

8. Professional Virtual Evaluation and Fees

 

The Professional Virtual Evaluation is an optional paid live telemedicine consultation. The current advertised fee is $150 USD unless a different price is clearly displayed before payment. Payment does not guarantee diagnosis, treatment recommendation, prescription treatment, or prescription fulfillment.

The price of any paid service, prescription product, or treatment option will be clearly communicated to you before payment is processed and before fulfillment is initiated.

9. Prescription Treatment and Fulfillment

 

Prescription products require a valid prescription issued by a licensed provider. Prescription treatment is issued only when clinically appropriate after eligibility screening, provider review, medical eligibility assessment, and approval by a Florida-licensed provider. You cannot purchase prescription products directly through the website without provider approval.

If prescription treatment is issued and fulfillment is applicable, fulfillment details will be provided after provider review and through an authorized dispensing pharmacy, as applicable. No prescription product is issued, dispensed, released, shipped, or fulfilled without provider approval and medical eligibility. Some kits may include supportive products in addition to prescription products.

10. Payments and Payment Privacy

 

You agree to provide accurate payment information and to pay any fees clearly disclosed before payment. You should not include medical symptoms, diagnoses, medication names, photographs, or health-related information in payment memo fields, bank-transfer notes, Zelle notes, PayPal notes, or similar payment fields.

11. Patient Responsibilities

 

You agree to provide accurate, complete, and current information and to update us if your information or health status changes. You agree not to submit false information, use another person’s identity, interfere with website operations, misuse communication channels, or use the platform for unlawful purposes.

12. Electronic Communications

 

By submitting your contact information, you authorize us to communicate with you using email, phone, SMS, WhatsApp, and other electronic channels for transactional and informational purposes related to your inquiry, eligibility review, evaluation, appointment, treatment coordination, prescription status if applicable, follow-up, and patient support. Marketing communications require separate optional consent where required by law.

13. Recording of Telemedicine Communications

 

Fugly Toenails™ and JAWS Podiatry do not routinely record telemedicine visits. Any recording by JAWS Podiatry will occur only with prior consent where required. Patients may not record audio, video, or screen content from a telemedicine consultation without prior consent from the provider and all participants, and any recording must comply with applicable law.

14. Privacy

 

Your use of the website and services is also governed by our Privacy Policy, HIPAA Notice of Privacy Practices, and applicable consent forms. Please review those documents carefully.

15. Intellectual Property

 

All website content, branding, logos, text, graphics, images, icons, designs, layouts, and other materials are owned by or licensed to JAWS Podiatry or Fugly Toenails™ unless otherwise stated. You may not copy, reproduce, distribute, modify, or use website content for commercial purposes without prior written permission.

16. Third-Party Links and Services

 

The website may contain links to third-party websites, platforms, pharmacies, payment processors, forms, scheduling tools, or other services. We are not responsible for the content, policies, security, or practices of third-party services, except as required by law or applicable agreements.

17. Disclaimers

 

The website and general informational content are provided “as is” and “as available.” We do not guarantee that the website will be uninterrupted, error-free, or free from security risks. Medical outcomes are not guaranteed. Treatment recommendations, prescription decisions, and prescription fulfillment depend on provider review and medical eligibility.

18. Limitation of Liability

 

To the fullest extent permitted by applicable law, JAWS Podiatry, Fugly Toenails™, and their owners, providers, staff, contractors, and representatives shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from website use, technical issues, third-party services, or delays, except where such limitation is prohibited by law. Nothing in these Terms is intended to limit rights or remedies that cannot legally be limited.

19. General Provisions

 

Severability. If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain in effect.

Entire Agreement. These Terms, together with the Privacy Policy, HIPAA Notice, Telemedicine Informed Consent, Refund / Return Policy, Accessibility Statement, and applicable consent forms, constitute the agreement regarding your use of the website and related services.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a business transfer, restructuring, or operational change, subject to applicable law.

No Waiver. Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Headings. Section headings are for convenience only and do not affect interpretation.

Notices. Notices may be provided through the website, email, mail, or other reasonable communication channels.

Force Majeure. JAWS Podiatry shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including natural disasters, public health emergencies, labor disruptions, internet or telecommunications failures, payment processor outages, pharmacy delays, government actions, or other events outside its reasonable control.

Governing Law and Venue. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to applicable law, venue for disputes shall be in the state or federal courts located in Florida.

Controlling Version. If a Spanish translation or any other translation is published or provided for convenience, the English version controls in the event of any conflict, ambiguity, or discrepancy.

20. Changes to These Terms

 

We may update these Terms from time to time. The “Last updated” date indicates when they were last revised. Continued use of the website after changes are posted means you acknowledge the updated Terms.
